Terms of Use

These Terms of Use ("Terms") govern access to and use of the ZapZap123 platform ("Platform"). By creating an account, accessing, or using the Platform, you agree to these Terms and the Privacy Policy.

1. Account and Access

  • You are responsible for maintaining the confidentiality of your account and password.
  • You must provide true information and keep it updated.
  • You are responsible for the use made from your account.
  • AI Usage: The service includes a monthly allowance of Artificial Intelligence (AI) generated messages, as described in the subscribed plan. Upon reaching the limit, the AI service will be interrupted until the next cycle or plan upgrade.

2. Use of the Platform

  • It is prohibited to use the Platform for illegal practices, spam, fraud, or violation of third-party rights.
  • You are responsible for the content sent/received and compliance with applicable laws and policies (e.g., WhatsApp).

2.1. WhatsApp Limitations and Blocking Risks

The Platform uses integration via QR Code (web client emulation). The user declares to be aware that:

  • Using automation on WhatsApp may lead to banning or blocking of the number by Meta/WhatsApp.
  • ZapZap123 is not responsible for any loss of numbers, bans, or commercial losses resulting from bans.
  • The user must follow the WhatsApp Commerce Policies and avoid sending SPAM or unsolicited bulk messages.

2.2. Artificial Intelligence (AI)

The Platform uses language models (AI) to generate automatic responses. The user acknowledges that:

  • AI may make errors, "hallucinations," or generate inaccurate responses.
  • The user is solely responsible for reviewing and configuring instructions (prompts) and supervising customer service.
  • We are not responsible for agreements, promises, or incorrect information provided by the AI to end contacts.

3. Subscription, Billing, and Cancellation

The Platform may be offered via recurring subscription. The prices and conditions displayed on the site/dashboard are part of the commercial offer in effect at the time of hiring. Cancellations end automatic renewal at the end of the paid period (unless otherwise provided in a specific offer).

3.1. Price Changes (Prior Notice)

Prices, plans, and commercial conditions may be changed with at least 30 (thirty) days' prior notice. If you do not agree with the change, you may cancel the subscription before the new billing/renewal.

4. Availability and Support

We seek to keep the Platform available, but interruptions may occur due to maintenance, updates, third-party failures, or external factors. We may offer support through official channels according to the contracted plan.

5. Intellectual Property

The Platform, brands, layouts, and codes belong to HSM Negócios Digitais LTDA or its licensors. You receive a limited, non-exclusive, and revocable license for use in accordance with these Terms.

6. Privacy

The processing of personal data follows the Privacy Policy.
